NFC Service Terms and Conditions

  1. These terms and conditions are in respect of the NFC Service ("Service"). The Service is provided to customers upon their subscription to an M1 NFC SIM card ("NFC SIM"). Upon termination of the customer's NFC SIM, the Service will also be terminated.

  2. Charges of S$35.00 (exclusive of GST) for the NFC SIM are applicable, as the case may be, for both new and replacement/upgrade of NFC SIM.

  3. The customer will be charged a one-time service activation fee of S$8.50 (exclusive of 7% GST) for the Service.

  4. The use of the Service on the NFC SIM facilitates mobile contactless services and transactions, including without limitation, payment services ("Third Party NFC Services") offered by Third Party NFC Service Providers.

  5. The use of the Service on the NFC SIM will require the use of appropriate M1-endorsed and NFC-certified handsets/devices enabled with specific operating systems that have been certified appropriate for NFC technology, as may be released or updated from time to time ("NFC Devices"). For the avoidance of doubt, M1 Limited ("M1") shall not be liable for any Service malfunction on the NFC SIM and/or any Third Party NFC Services arising from or in connection with the use of any inappropriate handsets/devices.

  6. All information, queries and instructions from the customer relating to Third Party NFC Services, including without limitation service suspension, service reactivation, customer support and technical assistance may be handled directly by the Third Party NFC Service Providers. M1 shall not be liable for any claims or losses incurred by any customer or any other person resulting whether directly or indirectly, in any manner whatsoever and howsoever arising from the customer's use of such Third Party NFC Services.

  7. M1 shall have the right to, at any time, change or otherwise modify any aspect or feature of the Service. M1 shall also have the right to, at any time, amend any rules, rates, fees, charges, and/or terms and conditions in respect of the NFC SIM or the Service, by publishing such amendments.

  8. If the customer's NFC SIM is lost or stolen during his tenure with M1, customer must either:
    1. buy a replacement NFC SIM at prevailing rates and pay for its associated charges in Clauses 2 and 3 (at prevailing rates), or
    2. replace with a non NFC SIM (i.e. normal postpaid SIM card) and terminate subscription to the Service. The customer will not be able to access any Third Party NFC Services upon termination of the customer's subscription to the Service.

  9. All charges are subject to change in accordance with the prevailing GST rate.

  10. Any other contract with the customer shall continue to apply, unless agreed otherwise by M1.

  11. To the fullest extent permitted by applicable law, M1's entire liability in contract, tort (including negligence or breach of statutory duty) or otherwise to the customer or any other person who uses our services (except for death or personal injury caused by our negligence) shall be limited to the replacement of the NFC SIM.

  12. M1's General Terms and Conditions published at www.m1.com.sg are deemed incorporated herein and shall apply to this contract. Any conflict or inconsistencies between the terms shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1 to the fullest extent permissible under applicable laws.
