M1 Limited BizText Service Terms and Conditions

M1 MAY MAKE CHANGES OR REVISE THE FOLLOWING TERMS AND CONDITIONS AT ANY TIME WHICH WILL BE PUBLISHED ON THIS WEBSITE. PLEASE ENSURE THAT YOU CHECK BACK PERIODICALLY TO ENSURE THAT YOU ARE AWARE OF ANY SUCH CHANGES OR REVISIONS. YOU ARE DEEMED TO HAVE AGREED TO THESE TERMS AND CONDITIONS AND ANY AMENDMENTS THERETO BY YOUR CONTINUED USE OF THIS SERVICE.

  1. Customers of M1 Limited ("M1") who sign up for the BizText Service ("Service") must fulfil a minimum commitment period of twelve (12) months ("Commitment Period"). In the event that the Customer prematurely terminates the Service before the expiry of the Commitment Period, the Customer shall pay to M1 the pro-rated subscription fees for the Service, for the remaining months of the Commitment Period based on M1's prevailing non-promotional rates for the Service. Customers are not allowed to temporarily disconnect the Services before completion of the Commitment Period.

  2. The Customer is responsible for the use of the Service under his account and for any content which is disseminated through his account. The Service should not be used to send messages that may be libelous or obscene, or cause irritation, annoyance, embarrassment, nuisance or harassment to anyone. The Customer shall use the Service for lawful purposes only, in accordance with the terms and conditions herein and any other applicable laws and regulations.

  3. Customers shall not spam or send out spam messages using the Service. In any event, Customers shall comply strictly with the Spam Control Act 2007 and any other applicable laws and regulations, and shall fully indemnify and hold M1 and/or its affiliates harmless against any and all claims, losses, damages and expenses arising out of the Customers' spamming or any breach of any of the terms and conditions herein.

  4. Each Customer (or Business Registration Number, as may be applicable) may only subscribe to one (1) SMS and one (1) MMS plan under the Service.

  5. The Customer is responsible for the security of his account information, including without limitation, User IDs and/or passwords in relation to the Service. In the event of any compromise in the security of the User IDs and/or passwords, the Customer must inform M1 immediately. Until such notification is made, the Customer shall be responsible for all consequences arising from any unauthorized use of the Service.

  6. The Customer acknowledges that M1 shall have the right (but not the obligation) to monitor any and all transmissions via the Service. The Customer further acknowledges and agrees that M1 shall have the right and sole discretion to block, filter, remove, limit, delete or modify any material or content transmitted by the Customer through access and use of the Service in the event that such material or content violates any of the terms and conditions herein. This is without prejudice to Clause 3 hereinabove, M1's rights to suspend or terminate the Service, and to take all action and claim the rights and remedies available to it at law or in equity.

  7. M1 may at any time with or without notice to the Customer, temporarily suspend the Service for operational reasons, including without limitation, maintenance, upgrade or improvement of the Service. In such event, the Service will be restored as soon as reasonably practicable.

  8. M1 shall not be liable for any messages that are not delivered to, or received by the intended recipient(s). The Service is provided by M1 on a best effort basis and the Customer uses the Service at his own risk. M1 does not guarantee the availability or continuity of the Service at all times at all areas. M1 expressly disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement, to the fullest extent allowed by law.

  9. M1 shall not be responsible for any loss or corruption of any data, including without limitation, contact information that is uploaded onto the BizText portal ("Portal") by Customers. Customers are solely responsible for ensuring that they have a backup copy of all data that they have uploaded onto the Portal, including all contact information.

  10. For the avoidance of doubt, M1 shall in no circumstances whatsoever, be liable for any hard drive crashes and any technical and/or other difficulties, problems or errors experienced by any Customer arising from any use of the Service. M1 may in its sole discretion extend help and assistance to such Customer as an act of goodwill but shall in no event be obliged to provide the same. The provision of such help and assistance shall in no event be deemed an acknowledgement and/or acceptance of liability by M1.

  11. To the maximum extent permitted by law, in no event shall M1 be liable for any costs, losses, liability or damage (whether direct or indirect) or for any incidental, consequential, special, or punitive damages or for any loss of revenue, business, profits or goodwill (even if M1 has been advised of the possibility of such damages), however caused, arising from or relating to the Service, including but not limited to damages arising from (a) loss of or damage to data; (b) violation of these terms and conditions; (c) the use or performance of the Service; or (d) failure of the Service herein.

  12. M1's General Terms and Conditions, and any other terms and conditions applicable for the provision of the Service, published at www.m1.com.sg are deemed incorporated herein and shall apply. Any conflict or inconsistencies in relation to any of the terms and conditions shall be resolved in a manner most favourable to M1, as determined by M1 at its sole discretion.
