Prepaid Mobile Services

DEFINITION AND INTERPRETATION

In these terms and conditions for Prepaid Mobile Services, except to the extent that the context requires otherwise, the following expressions shall have the meanings ascribed to them below:

“Applicable Laws” means all laws, code of practice, regulations, guidelines, instructions or other instruments having the force of law in whatsoever form that any competent regulatory, governmental or judicial authorities (“Authority”) in Singapore may issue from time to time relating to the services or otherwise;

“Prepaid Mobile Services” means any mobile services that are supplied to the customer on a prepaid basis, including without limitation mobile data services. Without prejudice to the foregoing but for the avoidance of doubt, products including without limitation, Prepaid SIM Cards and Top-Up Cards shall form part of the Prepaid Mobile Service;

“Prepaid SIM Card” means any prepaid card with a SIM Chip (including without limitation the M Card and SuperPac) which (a) requires registration for use; (b) has a fixed stored value and valid service period; and (c) allows access to and/or use of the Prepaid Mobile Service;

“Top-Up Card” means the physical or virtual top-up cards which are used to add value to Prepaid SIM Cards;

“Terms and Conditions” means these terms and conditions for Prepaid Mobile Services;

“Value Added Services” means the range of complementary and/or value added services provided by M1 and/or third party service providers.

APPLICABILITY OF TERMS

These Terms and Conditions are applicable to you upon your purchase, activation and/or use of your Prepaid Mobile Services, whichever takes place first.

Your use of the Prepaid Mobile Services is subject to your compliance with these Terms and Conditions, M1 General Terms and Conditions as stated on www.m1.com.sg, any specific terms and conditions for use of the Prepaid Mobile Services or any other terms and conditions as may be agreed between us (if any) and our prevailing policies, guidelines, instructions, notices and directions, as from time to time amended, modified or varied. In the event of any conflict or inconsistency between any applicable terms and conditions, such conflict and inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1 and its affiliates, to the fullest extent permissible under Applicable Laws.

To the fullest extent permissible under Applicable Laws, M1 may, at any time, amend, vary or supplement these Terms and Conditions (including any charges, tariffs, price plans and the benefits thereunder) and withdraw, suspend or change any of the Prepaid Mobile Services. We will, where it is reasonably practicable to do so, give you reasonable advance notice (which may be through written notice, electronic mail, letters, our website, our bills or such other forms as we deem appropriate) of such changes. If you continue to use the Prepaid Mobile Services after such notice, you will be deemed to have accepted the changes, which acceptance shall apply for the full term of the Prepaid Mobile Services. The prevailing terms and conditions as updated on our website www.m1.com.sg shall apply and supercede any and all previous versions, including in any user guide or application form.

Registration

In order to purchase and activate the Prepaid Mobile Services, you must register the Prepaid SIM Card. The following identification documents are necessary for registration:

  • Singaporeans: Pink identity cards or Singapore Passports
  • Singapore Permanent Residents: Blue identity cards or Passports
  • National Servicemen: SAF11 B, SPF11 B and SCDF11 B
  • Foreign Workers/Expatriates: Passports, Work Permit Identification Cards (issued from 3 May 1999), S Pass, Employment Pass, EntrePass, Training Employment Pass, Personalized Employment Pass or Work Holiday Pass
  • Foreign Visitors: Passports, Dependant’s Pass, Long Term Pass or Student’s Pass
  • Any other documentation as may be reasonably required by M1

You acknowledge and agree that your failure to register the Prepaid SIM Card or your purchase and/or use of any Prepaid SIM Card that has not been registered may be illegal and/or unlawful and you shall indemnify M1 against any damages, liabilities, losses and/or claims which M1 may suffer directly or indirectly, resulting from your acts or omissions or arising from your use of the Prepaid Mobile Services.

Your Prepaid SIM Card will be activated subject to these registration requirements. Upon successful registration, you may use the Prepaid Mobile Services for connection to our network.

The Prepaid Mobile Services should be used with equipment that is type-approved by the Info-communications Authority of Singapore (“IDA”).

Use

You shall use the Prepaid Mobile Services for lawful purposes only in accordance with these Terms and Conditions and in compliance with Applicable Laws.

You may not resell, distribute, provide, sublicense or offer in any way whatsoever, the Prepaid Mobile Services to any third party whether for profit or not, without M1’s approval in writing.

All Prepaid SIM Cards and Top-Up Cards are strictly not refundable once sold. M1 shall not be liable for any loss, theft, damage (including wear and tear) or misuse of the Prepaid SIM Card and/or Top-Up Card which you may suffer.

All unused value in the Prepaid SIM Cards and Top-Up Cards is strictly not refundable and not transferrable. All Prepaid SIM Cards should be activated and topped-up before their expiry date. Upon expiry, the Prepaid SIM Cards and Top-Up cards will be deactivated and all unused value will be forfeited. You shall not be entitled to claim any refund of such value for any reason whatsoever.

New Prepaid SIM cards activated from 15 November 2016 onwards can only be used on mobile devices that are compatible with 3G networks or above.

The speed and availability of the Prepaid Mobile Services is subject to coverage, location, devices used, network traffic and type of data being transmitted. The Prepaid Mobile Services, including any applicable High Speed Packet Access (HSPA) services, are subject to network availability, device capability and other conditions.

You will indemnify and hold M1 harmless against any damages, liabilities, losses, and/or claims brought against, suffered or sustained by M1, you or any third party, which arises directly or indirectly out of a breach of these Terms and Conditions by you, your acts or omissions, or by your use of the Prepaid Mobile Services.

Personal Data

We will respect your privacy and use, collect and disclose your personal data in accordance with Applicable Laws.

Subject to Applicable Laws, you agree to the provisions of the M1 Data Protection Policy concerning our collection, use and disclosure of your personal data and other matters as may be required under the Personal Data Protection Act 2012, as may be amended from time to time.

Without prejudice to the aforesaid, you acknowledge that M1 may, to the extent permitted by law, collect, use or disclose your personal data (which includes without limitation, your contact and identification information, payment records, detailed call records, and other information about your use of our network, products and services) for the following purposes:

  • To verify your identity, and to process your order(s) and application(s) for Prepaid Mobile Services;
  • To provide the Prepaid Mobile Services and to facilitate interconnection and inter-operability between telecommunications licensees in providing the Prepaid Mobile Services;
  • To inform you of any service updates, upgrades and related information in relation to the Prepaid Mobile Services, from time to time;
  • To respond and deal with enquiries or complaints and for other customer-care activities;
  • To carry out credit checks and for the evaluation of creditworthiness;
  • To manage, develop and improve our business and operations to serve you better;
  • To provide complementary or value added services;
  • To administer customer loyalty benefits and reward benefits;
  • To provide self-service channels for customer-care and account management activities;
  • To carry out contests and lucky draws;
  • To carry out market research and customer surveys;
  • To conduct investigations or take action in relation to bad debts, crime and fraud prevention, detection or prosecution;
  • To conduct investigations or take action in relation to any violation of any of our terms and conditions for Prepaid Mobile Services, including M1 General Terms and Conditions or our Acceptable Use Policies;
  • To third parties who perform any services relating to the Prepaid Mobile Services on our behalf, but only to the extent necessary for the services to be performed;
  • To protect and maintain your personal data, as well as to access and make corrections to your personal data;
  • To comply with legal and regulatory requirements imposed by any public agency;
  • Any other purpose necessary, ancillary or consequential to the above specified purposes.

Value Added Services

In the event you subscribe to any Value Added Services, you acknowledge and agree that your use of such Value Added Services will be subject to your compliance with M1’s General Terms and Conditions as stated on www.m1.com.sg, any specific terms and conditions for use of such Value Added Services or any other terms and conditions as may be agreed between us (if any) and our prevailing policies, guidelines, instructions, notices and directions as from time to time amended, modified or varied.

Suspension/Termination

In addition to the grounds for suspension and termination as set forth in the M1 General Terms and Conditions, M1 may, by giving you advance notice where reasonably practicable depending on the circumstances, suspend for a certain period as determined by M1 or terminate the Prepaid Mobile Services in the following circumstances:

  • If you fail to comply with these Terms and Conditions (including any registration requirements) or any other terms and conditions as may be agreed between us (if any);
  • If so directed by any relevant regulatory or governmental or judicial authority or law enforcement body.

NO WARRANTIES AND LIMITATION OF LIABILITY

Without prejudice to the aforesaid, but for the avoidance of doubt, the Prepaid Mobile Services are provided on an "as is" and "as available" basis and you accept that your access or use of the Prepaid Mobile Services are at your own risk. To the fullest extent permissible under Applicable Laws, M1 has excluded, and continues to exclude all statutory or tortuous liability (save for death or personal injury arising out of negligence) and disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. Without prejudice or limitation to the foregoing, M1 has not made, and makes no warranty as to the sequence, accuracy, completeness, security, compatibility, timeliness, reliability, quality, suitability, originality or non-infringement of the Prepaid Mobile Services, and M1 has not warranted, and does not warrant that the Prepaid Mobile Services will be provided uninterrupted or be available at all times or free from errors or viruses or that any identified defect can be corrected. To the extent M1 provides you with assistance in connection with any of the above, such assistance shall in no event be deemed an acknowledgement and/or acceptance of any liability on M1's part. Any waivers offered to you by M1 in its discretion shall be out of goodwill.

We will not be liable for any delay or failure in performance resulting from matters beyond our reasonable control, including without limitation acts of God, acts or omissions of third parties, requirements of any regulatory or governmental authority, national emergency, war, riots, strikes, industrial disputes (whether or not involving our employees), accident, lightning, fire, computer software or software malfunction, equipment failure, electrical power failure, faults, interruption or disruption of our network or the networks of other service providers or of your equipment or the equipment of any third party or epidemics caused by infectious diseases. Without prejudice to the foregoing, the Prepaid Mobile Services may occasionally be affected by interference caused by objects beyond our control such as buildings, underpasses and weather conditions. M1 will not be responsible for any such matters.

To the fullest extent allowed by Applicable Laws, in no event shall M1 be liable for any indirect, incidental, special, punitive, economic or consequential damages, losses, costs or expenses; or loss of revenue, profit, business opportunities, earnings or goodwill (whether direct or indirect) (collectively, “Losses”) whether based on warranty, contract, tort including negligence, strict liability under statute or otherwise, and whether or not M1 is advised of the possibility of such Losses suffered or incurred by you by reason of or in connection with the use of the Prepaid Mobile Services.

Notwithstanding the above, if for any reason M1 cannot rely on the limitations of liability set out hereinabove, or is liable to you under other grounds, and M1’s liability thereof is proven, M1’s maximum liability in contract, tort (including negligence or breach of statutory duty) or otherwise to you and anyone who uses the Prepaid Mobile Services (except for death or personal injury to the extent required by Applicable Laws) shall be limited to Singapore Dollars Five Thousand only (S$5000) or the total of your three (3) months’ usage preceding the event or series of events, whichever is lower.

General

No delay or failure by M1 to take any action or to enforce or exercise any of its rights under these Terms and Conditions will operate as a waiver of such rights by M1, nor will such failure or delay in any way prejudice or affect M1's rights at any time thereafter to act strictly in accordance with our rights under these Terms and Conditions.

If any of these Terms and Conditions held to be unenforceable, invalid or illegal for any reason, that provision shall to the extent permissible be severed, save and except that the remaining provisions shall remain in full force and effect to the extent applicable.

A person (including any user) who is not a party to the Prepaid Mobile Services contract with M1 has no right to enforce any of these Terms and Conditions under the Contracts (Rights of Third Parties) Act (Cap 53B).

Your access and/or use of the Prepaid Mobile Services is subject to compliance with these Terms and Conditions and shall be governed by and construed in accordance with the laws of Singapore and you agree to submit to the exclusive jurisdiction of the courts of Singapore. For the avoidance of doubt, M1 may initiate proceedings in any jurisdiction as it deems fit.

M Card Prepaid

  1. Local voice/video call rate of 8¢ per minute is valid from Monday to Friday 2000hrs to 0759hrs and from Saturday 0000hrs to Sunday 2359hrs. 16¢ per minute is valid from Monday to Friday 0800hrs to 1959hrs. Applicable to Free Incoming Call and Talk8 plans only.

  2. Air-time charges will follow prevailing rate at the beginning of each call till the end of the call.

  3. All dates and times stated will be based on that of M1’s system.

  4. Airtime charges apply for mobile calls made to "1800" local toll-free service numbers.

  5. M1's records will be used for the purpose of charging and shall be final and conclusive evidence of the duration of each call.

  6. 100MB Free Data for $5 M Card and 500MB Free Data for $15 M Card is valid for 30days, from day of activation.

  7. Pay-per-use local mobile data services are pre-activated and charged at 0.2¢/KB in blocks of 10KB.

  8. When roaming, M Card can only be used in countries where the foreign network operators support such roaming service. M1 is unable to guarantee the functions, including roaming, quality, charges and technical infrastructure, of the foreign network operators.

  9. Data roaming services will not be provided by default from 1st July 2011. Customers must enable data roaming on their mobile devices if the use of data roaming services is required.

  10. Deduction order is applicable to customers with various balances and irrespective of the expiry dates for the balances.

    For any local SMS sent, the deduction will be based on this order (where applicable):

    1. $17 M Card Top-up (Local SMS balance)
    2. $23 M Card Top-up (Local SMS balance)
    3. Bonus Balance
    4. $23 M Card Top-up (Bonus balance)
    5. Super Top-up (Local Calls/SMS balance)
    6. Free SMS balance
    7. Main balance

    For any local call made, the deduction will be based on this order (where applicable):

    1. $17 M Card Top-up (Local Outgoing Calls balance)
    2. $23 M Card Top-up (Local Outgoing Calls balance)
    3. Bonus Balance
    4. $23 M Card Top-up (Bonus balance)
    5. Super Top-up (Local Calls/SMS balance)
    6. Main balance

    For any IDD calls made or MMS/Global SMS sent, the deduction will be based on this order (where applicable):

    1. IDD Plans
    2. Bonus Balance
    3. $23 M Card Top-up (Bonus balance)
    4. Super Top-up (IDD/Others balance)
    5. Main balance

    For local data used, the deduction will be based on this order (where applicable):

    1. Weekend Free Data balance
    2. Bonus data balance
    3. Free data balance
    4. Promo data balance
    5. China/Malaysia IDD Plan data balance
    6. Prepaid BlackBerry data balance
    7. Prepaid Data balance
    8. $17 M Card Top-up (Local data balance)
    9. $23 M Card Top-up (Local data balance)
    10. Super Data Top-up (Local data balance)
    11. Bonus Balance
    12. Rewards data balance
    13. $23 M Card Top-up (Bonus balance)
    14. Super Top-up (IDD/Others balance)
    15. Main balance

    For roaming charges, the deduction will be based on this order (where applicable):

    1. Super Top-up (IDD/Others balance)

Price Plan

  1. Change of price plan is chargeable at $1 per request. Customers must ensure that they have a Main Balance of at least $1 before making the request as the charge will only be deducted from the customer's Main Balance.

  2. All customers must be active users at the point of time when the price plan is changed. Price plan changes cannot be performed for cards which have been suspended.

  3. Change of price plan is only applicable for change to Free Incoming Call or Talk8.

Free Incoming Calls

  1. Customers must ensure that they have (i) a minimum card balance of 60¢; and (ii) daily deduction of at least 60¢/day; in order to enjoy Free Incoming Calls.

  2. The Free Incoming Calls are only applicable to calls received in Singapore.

Top-Ups

  1. Any applicable bonus value given for top-ups will be credited to the M Card Bonus Balance with 30 days validity. The credits in the Bonus Balance can only be used for pay-per-use local data, local calls/SMS/MMS, international calls/global SMS and Connecting Tones services.

  2. To protect our customers’ interests, the maximum amount for topping up into M Card is $800. M1 reserves the right to amend this limit at any time without prior notice.

Super Data / Super $130 / Super $55 Top-Up

  1. Each $30 Super Data includes:
    • $100 worth of Local SMS and Local calls
    • 2GB worth of Local data

  2. Each $28 Super $130 includes:
    • $100 worth of Local SMS and Local calls
    • $30 worth of IDD calls, Global SMS and other services

  3. Each $15 Super $55 includes:
    • $40 worth of Local SMS and Local calls
    • $15 worth of IDD calls, Global SMS and other services
    • Free incoming calls for 10 days

  4. Super $130 top-up price promotion is applicable to M1 prepaid customers who top up $28 via the new physical card, AXS, M1 website, Postpaid line, SAM, M1 Prepaid Mastercard, and E-load from 11 June 2012 onwards.

  5. Super Data top-up is applicable to M1 prepaid customers who top up via M1 Online Top-up, M1 Postpaid Line, AXS Stations/Terminals/e-Station/m-Station, DBS/POSB ATMs/iBanking/SMS Banking services, DBS PayLah! App, E-load (M1 Shops & M1 E-load retailers), eTop-up at 7-Eleven stores (except Changi Airport and all Shell stations) and selected iNETS D1+ Terminals.

  6. The 10 days of free incoming calls for Super $55 are only applicable to calls received in Singapore.

  7. Unused Super $130 / Super $55 benefits will be carried forward when you top up with another Super $130 / Super $55 within 50 days from the last Super $130 / Super $55 top-up.

  8. Unused Super Data benefits will be carried forward when you top up with another Super Data Top-Up within 30 days from the last Super Data top-up. There is no limit to the balances carried forward.

  9. Unused Super Data / Super $130 / Super $55 balances will not be rolled over when you top up with any other M1 Prepaid Top-up denominations.

  10. Each Super $130 / Super $55 expires in 50 days from the day of top-up.

  11. Each Super Data expires in 30 days from the day of top-up.

$17 M Card Top-Up

  1. $17 M Card Top-Up benefits are applicable to all M Card customers.

  2. The $17 M Card Top-Up allows eligible customers to enjoy 120 min of local outgoing talk time ($18 @ $0.15/min), 500 local SMS, 200MB of local data usage and 30 days of Free Incoming Calls from 11 Sept 2013 onwards.

  3. Local outgoing calls, upon topping up $17 M Card Top-Up, will be charged at $0.15/min till the $17 Local Outgoing Call balance is depleted or till the expiry (whichever is earlier). After which, usual airtime rates for respective Price Plans apply.

  4. For customers under Free Incoming Calls Price Plan, there will be no daily deduction of $0.60. At the end of the Free Incoming Call validity date, the Free Incoming Call Plan will automatically be re-activated and $0.60 deducted unless another $17 M Card Top-Up is performed.

$23 M Card Top-Up

  1. $23 M Card Top-Up benefits are applicable to all M Card customers.

  2. The $23 M Card Top-Up allows eligible customers to enjoy 350MB of local data, $12 bonus, 120 mins of local outgoing talk time ($18 @ $0.15/min), 500 local SMS, and 50 days of Free Incoming Calls.

  3. Local outgoing calls, upon topping up $23 M Card Top-Up, will be charged at $0.15/min till the $23 Local Outgoing Call balance is depleted or till the expiry (whichever is earlier). After which, usual airtime rates for respective Price Plans apply.

  4. The bonus given with $23 M Card Top-Up can be used for International calls/SMS and others except for roaming uses.

  5. For customers under Free Incoming Calls Price Plan, there will be no daily deduction of $0.60. At the end of the Free Incoming Call validity date, the Free Incoming Call Plan will automatically be re-activated and $0.60 deducted unless another $23 M Card Top-Up is performed.

Data Plans

Prepaid Data Plans

  1. Prepaid Data Plans are a value-added service applicable to M Card customers.

  2. Applicable subscription fees for Prepaid Data Plans will be deducted from the customers’ Main Balance.

  3. All Prepaid Data Plans utilize 4G speeds with theoretical download speed of 300Mbps and upload speed of 50Mbps. It is only available with 4G service on compatible 4G smartphones.

  4. The typical speed range refers to the range of download speed that users can experience 80% of the time based on the specific test conditions and parameters which are stipulated on our website www.m1.com.sg/MBBspeeds.

  5. Time is based on a 24-hour clock cycle from the time of plan activation.

  6. Prepaid Data Plan is valid for use while in Singapore, unless otherwise stated. Prevailing roaming GPRS rates will apply and will be deducted from available Roaming Balance(s).

  7. Multiple subscriptions are allowed and the remaining data will be rolled over as long as another subscription is made before the current plan expires. Maximum data balance for Prepaid Data Plans is up to 4GB at any given time.

  8. Any data usage in excess of the Free Bundled Data will be charged at 0.2¢/KB and will be deducted from your available balances accordingly.

  9. Any remaining or unused bundle will be forfeited after the plan expires and/or subject to maximum card validity, whichever comes first.

  10. M1 will not, in any circumstances, entertain any claim for a refund pertaining to the Data Plan purchased.

  11. M1 is not responsible for corruption or removal of any files or documents due to the use of the Data Plan service.

Prepaid BlackBerry Plans

  1. Blackberry Prepaid plans are a value-added service applicable to all M Card customers.

  2. Applicable subscription fees for Blackberry Prepaid plans will be deducted from the customers’ Main Balance.

  3. Time is based on a 24-hour clock cycle from the time of plan activation.

  4. The Free Bundled Data applies only to local data usage and will expire together with the Blackberry Prepaid plan(s) purchased. The Free Bundled Data may be utilized for internet surfing via Blackberry APN, MiWorld APN & SunSurf APN.

  5. Any data usage in excess of the Free Bundled Data will be charged at 0.2¢/KB and will be deducted from your available balances accordingly.

  6. Any unused Free Bundled Data may be rolled over so long as there is another Blackberry Prepaid plan subscription made before the expiry of an existing subscription. If there is no additional subscription made prior to expiry, unused Free Bundled Data will expire together with the Blackberry Prepaid plan(s) purchased and/or subject to maximum card validity, whichever comes first.

  7. Prevailing data roaming rates apply when roaming.

  8. M1 will not, in any circumstances, entertain any claim for a refund pertaining to the Data Plan(s) purchased.

Data Roaming

  1. M Card customers are able to use local Eligible Prepaid Data Bundles on foreign Preferred Networks.

  2. The local Eligible Prepaid Data Bundles are:
    1. Weekend Free Data balance
    2. Travel SIM Local Data Bundle
    3. Free data balance
    4. Promo data balance
    5. China/Malaysia IDD Plan Data Bundle
    6. Prepaid BlackBerry Data Bundle
    7. Prepaid Data Plans
    8. $17 M Card Top-up Data Bundle
    9. $23 M Card Top-up Data Bundle
    10. Super Data Top Up (Local data balance)
    11. Rewards data balance

  3. The Preferred Networks are:
    1. Celcom (Malaysia)
    2. Chunghwa Telecom (Taiwan)
    3. SmarTone (Hong Kong)
    4. SmarTone (Macau)
    5. XL Axiata (Indonesia)

  4. All other data bundles not listed under the local Eligible Prepaid Data Bundles list will not be eligible for use on any foreign networks.

  5. Excess data usages beyond the local Eligible Prepaid Data Bundles on Preferred Networks will be charged at prevailing data roaming rates and deducted from the available balances eligible for roaming usage accordingly.

  6. All data roaming usages on all other foreign networks other than the Preferred Networks will not be deducted from the local Eligible Prepaid Data Bundles and continue to be charged at prevailing data roaming rates. It is solely the customer’s responsibility to ensure that they are connected to the Preferred Networks at all times to prevent being charged at prevailing data roaming rates.

  7. All non-data roaming usages (e.g. Calls/SMS/MMS) will continue to be charged at prevailing roaming rates.

  8. The order of payment deduction will be determined by M1 and is applicable to customers with various balances and irrespective of the expiry dates for the balances.

  9. For any overseas data used on Preferred Networks, the deduction will be based on this order (where applicable):
    1. Weekend Free Data balance
    2. Travel SIM Local Data Bundle
    3. Travel SIM IDD Calls/Global SMS balance (at 2¢/10kb charge)
    4. Free data balance
    5. Promo data balance
    6. China/Malaysia IDD Plan Data Bundle
    7. Prepaid BlackBerry Data Bundle
    8. Prepaid Data balance
    9. $17 M Card Top-up Data Bundle
    10. $23 M Card Top-up Data Bundle
    11. Super Data Top Up (Local data balance)
    12. Rewards data balance
    13. Super Top-up (IDD/Others balance at 2¢/10kb charge)
    14. Main balance (at 2¢/10kb charge)

  10. For non-data roaming services on Preferred Networks and or all roaming services on all other networks, the deduction will be based on this order at prevailing roaming rates (where applicable):

  11. Customers must enable data roaming on their mobile devices before using this service, and a minimum of S$8 in the Main Balance is required.

  12. When roaming, M Card can only be used in countries where the foreign network operators support such roaming service. M1 is unable to guarantee the functions, including roaming, quality, charges and technical infrastructure of the foreign network operators.

  13. M1 will not, in any circumstances and for any reasons whatsoever, entertain any claim for a refund or any claims pertaining to or arising out of the use of this service.

  14. M1 is not responsible for corruption or removal of any files or documents due to the use of M1’s Data Plan service.

  15. M1 reserves the right to vary these terms and conditions without prior notice.

  16. M1 General Terms and Conditions additionally apply and in the event of any inconsistencies between these terms and the General Terms and Conditions, the inconsistency shall be resolved in a manner favourable to M1.

Network Lock

  1. Network Lock is a complimentary feature that is provisioned with the activation of Data Roaming services. The Network Lock feature will automatically be removed upon de-activation of the aforementioned services.

  2. You may manually enable or disable Network Lock via USSD #100#. You will receive a confirmation SMS upon successfully manually enabling or disabling Network Lock.

  3. When Network Lock is enabled in any of the countries on the Network Lock List, Data Roaming will be enabled only on the preferred networks, as stated.

  4. When Network Lock is enabled in countries not listed on the Network Lock List, Data Roaming will be enabled on any available roaming network.

  5. When Network Lock is disabled, Data Roaming will be enabled on all available roaming networks (including the countries listed on the Network Lock List).

  6. For the avoidance of doubt, the Network Lock feature is provided on an "as is" and "as available" basis and you accept that your access or use of Data Roaming services are at your own risk. To the fullest extent permissible under applicable laws, M1 has excluded, and continues to exclude all statutory or tortious liability (save for death or personal injury arising out of negligence) and disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. M1 has does not represent or warrant that the Data Roaming services will be provided uninterrupted or be available at all times or free from defects, errors or viruses or that any identified defect can be corrected. To the extent M1 provides you with assistance in connection with any of the above, such assistance shall in no event be deemed an acknowledgement and/or acceptance of any liability on M1's part. Any waivers offered to you by M1 in its discretion shall be out of goodwill.

  7. M1 reserves the right to modify or revise these Network Lock Terms and Conditions (“Terms”) from time to time upon notice in such manner as M1 deems appropriate, which may include publication of such amended Terms on www.m1.com.sg. You are encouraged to check back periodically to ensure that you are aware of any such amendments. Your continued use of Data Roaming services will constitute your acceptance of these Terms as may be amended.

  8. M1’s General Terms and Conditions available at www.m1.com.sg are deemed incorporated herein and shall apply. In the event of any conflict or inconsistency between the terms, such conflict or inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1, to the fullest extent permissible under applicable laws.

Value Added Services

Validity Extension

  1. Main Balance Validity Extension VAS (“Validity Extension”) can only be purchased via USSD #100*6#.

  2. Validity Extension purchased will only extend the Main Balance. The expiry of all other balances will not be extended.

  3. Fee for the purchase of Validity Extension will be deducted from the Main Balance accordingly to the extension purchased.

  4. Any promotional prices listed are valid until further notice.

  5. Validity Extension is only applicable to M Card customers who are on Talk8 & Free Incoming Call plans, including Travel SIM.

  6. M1 will not, in any circumstances, entertain any claim for a refund pertaining to the Validity Extension purchased.

  7. M1 reserves the right to amend or vary any promotional prices and Terms & Conditions at its discretions.

4G Data Service Activation

  1. Free 4G Data Service can only be activated via USSD #100*3*3#

  2. Free 4G Data Service Activation via USSD is valid till further notice.

  3. 4G Data Service Activation is only applicable to M Card customers who are on Talk8, Free Incoming Call and ChatEZ plans, including Travel SIM.

  4. M1 reserves the right to amend the Terms and Conditions.

Prepaid Tourist SIM Card

  1. The $15 Prepaid Tourist SIM Card comes with:

  3. All unused Tourist SIM Card balances will expire and be forfeited after the stated validity.

  5. Local data is limited to usage in Singapore only. Pay-per-use local mobile data services are pre-activated and charged at 0.2¢/KB in blocks of 10KB.

  6. Local Calls and International Calls are charged in per minute blocks.

Free IDD 021 calls to 19 Destinations

  1. Free IDD 021 calls to 19 destinations include: Australia, Bangladesh, Brunei, Canada, China, Hong Kong, India, Laos, Macau, Malaysia, New Zealand, Puerto Rico, Russia, South Korea, Taiwan, Thailand, United Kingdom, USA and Vietnam.

  2. Free IDD 021 is applicable for voice calls made to (i) any residential line in Australia and New Zealand; and (ii) United Kingdom residential lines with prefixes 44-1 and 44-2 only.

  3. Calls are charged in per minute blocks.

  4. Local airtime charges apply for all countries.

  5. This promotion is valid till 31 December 2017.

FREE IDD 021 minutes

  1. This IDD Promotion is valid till further notice and is only applicable for M Card customers who make IDD 021 calls to China, Malaysia, Indonesia, Philippines and Vietnam.

  2. Customers will enjoy FREE 10 minutes IDD 021 call AFTER the first 8 minutes to one of the above destinations. The FREE 10 minutes of IDD 021 call to the destination will only be awarded ONCE per call and must be utilized within the same call. Any unutilized free minutes shall be automatically forfeited.

  3. There are no limits to the number of times a customer can enjoy the 10 minutes of FREE IDD 021 call to the selected destination each day.

  4. The chargeable duration of IDD 021 calls will be charged based on the M Card prevailing IDD 021 rate to each of the selected countries. For destinations such as China, Malaysia and Vietnam (being free IDD 021 countries), only local calls charges are applicable.

  5. This IDD Promotion is applicable to all M Card customers, including customers who top-up with SUPER$130/ SUPER$55/ $23 M Card Top-ups.

  6. Customers making calls using SUPER$130/ SUPER$55/ $23 M Card Top-ups, shall be entitled to this IDD Promotion with the cost of IDD 021 calls being deducted from the respective SUPER$130/ SUPER$55/ $23 M Card Top-up balances. In the event of unavailable or insufficient credit in the customer's IDD/Others balance, the cost of the IDD 021 calls will be deducted from the customer's main balance.

  7. This IDD Promotion applies to both fixed lines and mobile lines. M1 reserves the right to amend or vary any promotional terms at its discretion.

FREE Global/ Local SMS

  1. The first 5 Global SMSes to eligible destinations / first 5 Local SMSes daily can be deducted as pay-per-use charge and/or free SMS, whichever applicable.

  2. 75 free global SMS / 10 free local SMS are valid till and must be utilized by 2359hrs on the same day. Any unused free SMS will be forfeited and will not be rolled over to the next day.

  3. Each promotion is only applicable to each M Card user once a day (0000 - 2359hrs).

  4. Eligible destinations for free Global SMS include: China, Malaysia, Indonesia, Philippines and Vietnam.

  5. This promotion is valid until further notice.

8¢/min to Philippines on Saturdays

  1. 8¢/min to all networks in the Philippines with IDD 021 is valid on Saturdays from 0000hr to 2359hr.

  2. The promotional rate is applicable from the 2nd minute onwards.

  3. This promotion is applicable for all M Card customers on Talk8 and Free Incoming Call plans.

Free Local Data

  1. Free 100MB / 500MB of local data will apply to all M Cards activated from 28 January 2016, valid for thirty (30) days from day of activation. It is not applicable to customers under SuperPac plan or Prepaid Broadband/ Data plans.

  2. Free 10MB of local data will apply to top-ups of at least $18, valid for three (3) days from day of top-up. It is not applicable to customers under SuperPac plan or Prepaid Broadband/ Data plans.

  3. Extension of expiry and rollover of remaining data balance is allowed as long as another valid top-up is made before the free data expires.

  4. Free local data is valid for use while in Singapore, Malaysia (Celcom) and Indonesia (XL Axiata). Prevailing roaming GPRS rates will apply and will be deducted from Main Balance.

  5. Any data usage in excess of the Free Data Balance will be charged at 0.2¢/KB and will be deducted from your available balances accordingly.

  6. Any remaining or unused local data will be forfeited upon expiry of the Free Data Bundle and/or subject to maximum card validity, whichever comes first.

  7. M1 will not, in any circumstances, entertain any claim for a refund pertaining to the Data Plan purchased.

Prepaid Handset Rental Promotion

  1. M1 LIMITED (“M1”) customers who purchase any of the M1 prepaid bundles shall be entitled to one Huawei Ascend Y220 (“Handset”) to be used only on M1’s network for the contractual period of 12 months commencing from the date of sign-up. Customers are not required to make any up-front or monthly payments for the Handset on the basis that customers will comply with all the contractual terms stated herein and/or published at www.m1.com.sg where applicable.

  2. The customer is required to remain on M1’s Network for a period of twelve (12) months commencing from the date of the sign-up of this Contract (“Minimum Term”). In the event any party terminates this Contract prior to the expiry of the Minimum Term, M1 reserves its rights to claim against the customer for all losses and/or damages suffered or incurred by M1.

  3. The customer must keep the handset in good working order and condition at all times. This means without limitation, the following: (i) the Handset must be able to power up; (ii) there are no cracks on the LCD screen of the Handset; and (iii) the Handset must be returned with its original battery, charger, and all other accessories including memory card(s), data cable(s) and stylus, as may be applicable (collectively “Accessories”). Usual air-time rates for the respective Price Plans will only be applicable upon depletion of the local outgoing talk time or upon the expiry of the $23 top-up (whichever is earlier).

  4. Upon (a) the expiry of the Minimum Term, or (b) any earlier termination of this Contract by M1 or the customer, or (c) upon demand by M1, the Handset and Accessories must be returned by the customer personally, to any M1 Customer Service Centre, in good working order and condition (as described above). M1 shall decide in its discretion if the Handset and Accessories are in good working order and condition.

  5. In the event that the Handset and/or Accessories are not returned to M1, or are not returned in good working order and condition, M1 reserves the right to claim from the customer the full M1 recommended retail price of the Handset and/or accessories then prevailing, or the sum of S$20, whichever is higher.

  6. The Handset and Accessories shall remain the sole property of M1 and M1 shall retain full legal and beneficial title to the Handset and Accessories at all times. The use of the Handset and Accessories by the customer shall be in accordance with these terms herein and on the basis of a full reservation and retention of M1’s title in and to the Handset and Accessories.

  7. The Handset and Accessories may not be sold, transferred, gifted or disposed of in any manner whatsoever to any third party (whether person, entity or other legal persona) without the prior written consent of M1 (which consent may be refused in M1’s discretion without assigning any reasons). The customer must not modify or allow anyone to modify the Handset and Accessories.

  8. Where necessary, the customer is responsible for bringing the Handset to the manufacturer’s service centers for repairs and/or to obtain a replacement handset. The customer shall pay all costs and expenses of any repair and/or replacement costs which the customer may incur for the Handset and Accessories.

  9. Upon completion of the Minimum Term, the Handset and Accessories must be returned by the customer personally, to any M1 Customer Center. Provided that the customer has not breached any terms and conditions, M1 Customer Service Center will then facilitate transfer of ownership for the Handset and unlock the Handset so that it can be used on other mobile networks, free-of-charge. For the avoidance of doubt, M1 shall retain ownership of the title to the Handset for as long as the Handset is SIM locked to M1.

Free 100GB Activation Bonus Local Data Promotion

  1. Free 100GB Activation Bonus Local Data Promotion (“Promotion”) is valid until 30 November 2016 23:50PM (“Promotion Period”).

  2. The Promotion is applicable to the following Prepaid Travel SIM cards activated during the Promotion Period:
    • $30 Prepaid Travel SIM Card
    • $50 Prepaid Travel SIM Card

M Send Singapore Service Specific Terms and Conditions

  1. The M Send Singapore service (“Service”) is available to all M1 prepaid mobile customers with an active M Card account (“Customers”).

  2. The Service allows Customers to transfer pre-determined denominations of prepaid credits (“Prepaid Credits”) to a receiving M Card account(s) (“Recipient(s)”) in Singapore.

  3. Upon Service initiation, the available Prepaid Credit denominations will be displayed in Singapore Dollars (SGD) via USSD and the Customer must select the desired pre-determined denomination to be transferred to the Recipient. A Transaction Fee of SGD$0.05 shall be charged to Customer for each successful transfer.

  4. Upon the Customer’s confirmation of transfer of Prepaid Credits, the selected Prepaid Credit denomination and the Transaction Fee will be deducted from the Customer’s Main Balance and the transfer value as specified by the Customer will be made to the Recipient(s). The deduction and transfer of credit will only take place if the Customer has sufficient credit in Customer’s Main Balance.

  5. Prepaid Credits transferred to the Recipient via the Service shall have the following validities periods:

  7. M1 will not entertain any requests for transaction reversal or refunds once the Prepaid Credits transfer transaction has been completed.

  8. M1 may revise and amend the available Prepaid Credit denominations from time to time. M1 will, where it is reasonably practicable to do so, give Customers reasonable advance notice (which may be through written notice, electronic mail, M1’s website, Customers’ bills or such forms as M1 deems appropriate) of such changes.

  9. Use of the Service is subject to Customers’ compliance with these Terms and Conditions, M1 General Terms and Conditions, and M1’s Prepaid Mobile Service terms and conditions which are published on www.m1.com.sg. In the event of any conflict or inconsistency between any applicable terms and conditions, such conflict and inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1, to the fullest extent permissible under applicable laws.

M Send International Service Specific Terms and Conditions

  1. The M Send International service (“Service”) is available to all M1 prepaid mobile customers with an active prepaid account (“Customers”).

  2. The Service allows Customers to purchase pre-determined denominations of prepaid credits (“Prepaid Credits”) to supported prepaid mobile number account(s) (“Recipient(s)”) in the following countries:

    • Bangladesh
    • China
    • India
    • Indonesia
    • Malaysia
    • Myanmar
    • Philippines
    • Sri Lanka
    • Thailand
    • Vietnam

  3. All Prepaid Credits transferred to the Recipient via the Service may only be used by the Recipient for mobile-related services such as voice calls, international calls, SMS and data usage.

  4. Upon the initiation of a transfer of Prepaid Credits by a Customer, the available Prepaid Credit denominations will be displayed in USSD menu in the relevant overseas currency (e.g. BDT for Bangladesh) with the corresponding amount in Singapore Dollars (SGD). The amount in Singapore Dollars (SGD) will be deducted from the Customer’s M Card Main Balance. The top up amount received by the Recipient may be subject to deductions applicable in the countries in which the Recipient is based.

  5. Upon the Customer’s confirmation of transfer transfer of Prepaid Credits, the chosen Prepaid Credit denomination as displayed in SGD shall be deducted from the Customer’s M Card Main Balance and the top-up will be made to the Recipient’s supported prepaid mobile number account(s) as specified by the Customer. The deduction and transfer of credit will only take place if the Customer has sufficient balance in his M Card Main Balance.

  6. Each M Card account is subject to the following limits:

    • Maximum of 5 transactions or total transacted value of $30 per day
    • Maximum of 15 transaction or total transacted value of $150 per 7 days
    • Maximum of 30 transactions or total transacted value of $300 per 30 days

    M1 reserves the right to reject any Customer’s use of the Service if any of the above limits are or will be exceeded.

  7. M1 shall not entertain any claims by the Customer for any refunds once the international prepaid airtime transfer transaction has been effected and the Prepaid Credit top-up value has been debited to the Recipient’s prepaid mobile account(s) overseas.

  8. M1 may revise and amend the pricing of the Prepaid Credits at any time from time to time. M1 will, where it is reasonably practicable to do so, give Customers reasonable advance notice (which may be through written notice, electronic mail, M1’s website, Customers’ bills or such forms as M1 deems appropriate) of such changes.

  9. Use of the Service is subject to Customers’ compliance with these Terms and Conditions, M1 General Terms and Conditions, and M1’s Prepaid Mobile Service terms and conditions which are published on www.m1.com.sg. In the event of any conflict or inconsistency between any applicable terms and conditions, such conflict and inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1, to the fullest extent permissible under applicable laws.

“Top up via AXS Station and stand to win a Samsung Galaxy Tab A or 20GB Data!” M Card Prepaid Top-up Promotion

  1. This Promotion is open to all M1 Limited (“M1”) and AXS Pte Ltd (“AXS”) and is subject to these terms and conditions (“Terms”).

  2. The Promotion is open to all M1 Prepaid customers with an active prepaid mobile account during the Qualifying Period (as defined below) (“Customers”). Staffs of AXS and their spouses, M1 and its agencies and auditors directly involved in the Promotion are not eligible to participate in the Promotion.

  3. AXS may from time to time in its absolute discretion decide on the eligibility of participation in the Promotion.

  4. The qualifying period for the Promotion shall commence from 3 February to 30 April 2016, both dates inclusive (“Qualifying Period”).

  5. Customers will receive one (1) chance with any top-up to their M1 prepaid card(s) via AXS Station during the Qualifying Period.

  6. There is no limit to the number of top-ups a Customer may perform.

  7. The total prizes of the Promotion shall be as follows (“Prize”)

In the event a winner fails to collect a Prize within the collection period and/or fails to comply with any other instruction or condition specified by AXS, the Prize may be forfeited at AXS’s absolute discretion.

  16. The Prize is not transferable, redeemable or exchangeable for cash, credit or kind or other prize. There will be no replacement for lost or stolen Prize.

  17. AXS and/or M1 reserve the rights to substitute the Prize with another prize of lower or equivalent value, whether of similar nature or otherwise without prior notice.

  18. AXS shall not be liable to any person in any way for any loss or damage howsoever arising from or in connection with the Promotion and/or any of the Prizes.
