| 1. | Customers will start their service subscription commitment period from their date of purchase of the subsidised iPhone up to 24 months thereafter (the "Commitment Period"). |
| 2. | In the event that the customer prematurely terminates M1's services / downgrades bill plan during the Commitment Period, he shall pay the termination charge stated in the iPhone Contract. |
| 3. | Customer who defaults on payment of his bill and is terminated by M1 during the Commitment Period will also have to pay the termination charge stated in the iPhone Contract. |
| 4. | Customer who downgrades to a lower subscription service plan during the Commitment Period shall pay M1 the downgrade charge stated in the iPhone Contract. | 5. | If the customer's mobile phone / data device is lost or stolen during the Commitment Period, customer will have to either: | a | buy a new mobile phone / data device at the recommended retail price and continue with the subscription for the full Commitment Period; - or | | b | terminate prematurely and pay M1 the termination charge as stated in Clause 2. | |
| 6. | Customer is not allowed to temporarily disconnect M1's services during the Commitment Period. |
| 7. | Customer is not allowed to transfer the M1 line bound by iPhone Contract. |
| 8. | All charges are subject to change in accordance with the prevailing GST rate. |
| 9. | Any other contract with the customer shall continue to apply, unless agreed otherwise by M1. |
| 10. | To the fullest extent permitted by law: | a | all iPhone handsets ("Handsets") are sold on an "as is" and "as available" basis and all warranties express or implied are excluded; and | | b | you confirm that you have examined the Handset and that the same is free of any external or other defect (including but not limited to scratches and dents) which would be apparent to you upon your reasonable examination. | |
| 11. | In the event M1 provides you with a replacement handset ("Replacement"), you acknowledge and agree that such Replacement shall be a replacement handset as determined or provided by the manufacturer to M1 for such purpose in accordance with the manufacturer's policies, terms, and conditions. |
| 12. | M1's General Terms and Conditions published at www.m1.com.sg are deemed incorporated herein and shall apply to this contract. Any conflict or inconsistencies between the terms shall be resolved in a manner most favorable to M1 as determined by M1 at its sole discretion. |
